BATTLE OF THE EXPERTS IN CLASS CERTIFICATION
The Second Circuit Court of Appeals recently instructed a district court to explicitly weigh the conflicting opinions of two economic experts in a class certification decision. The decision marks a departure from the traditional treatment of class certification in antitrust matters in which district courts decide class certification issues without conducting the proverbial "battle of the experts."
